  1.                               The PC-SIG Library

  3.                   Electronic Bulletin Board System License
  4.  
  5.     The use of The PC-SIG Library on CD ROM on electronic bulletin board
  6.     systems (BBS) is prohibited without a license from PC-SIG, Inc.  This
  7.     License Agreement is between PC-SIG, Inc. and the BBS operator whose
  8.     signature appears at the end of this Agreement.  In return for the
  9.     limited right to use The PC-SIG Library, the BBS Licensee agrees to
  10.     the provisions of this License.  This Agreement allows the BBS Licensee
  11.     to use The PC-SIG Library for the period of one year from the date of
  12.     this License.
  13.  
  14.     1.    PC-SIG's copyright covers the research, editing,
  15.           organization and compilation aspects of PC-SIG Library
  16.           diskettes and CD ROMs as well as any individual programs or
  17.           descriptive materials which are the original creation of
  18.           PC-SIG. Unless otherwise specified, PC-SIG does not claim
  19.           literary rights in individual programs which have been
  20.           licensed for use.

  22.     2.    This License Agreement allows the BBS Licensee to use
  23.           PC-SIG's name, diskette numbering system and corresponding
  24.           titles, and PC-SIG developed text files including, but not
  25.           limited to, diskette descriptions.

  27.     3.    BBS Licensee agrees to respect the author's copyright
  28.           notices on the Shareware software and PC-SIG's copyrights
  29.           and trademarks. PC-SIG's copyrighted materials include the
  30.           directory on disk, all printed directories and encyclopedias, 
  31.           PC-SIG Hotsheet, PC-SIG Magazine and Shareware Magazine.

  33.     4.    The BBS Licensee must have the capability, and agree, to
  34.           deny access to any program, file, or diskette on their BBS
  35.           system that has been withdrawn from The PC-SIG Library.
  36.           Notification of program, file, or diskette withdrawal from
  37.           The PC-SIG Library will be published in "Shareware Magazine"
  38.           and/or the PC-SIG Hotsheet that is sent to Licensee. It is
  39.           the responsibility of the BBS Licensee to monitor the above
  40.           publications and to maintain their BBS according to the
  41.           current distribution status as reflected in those publications.

  43.     5.    BBS Licensee agrees to display the PC-SIG Introduction
  44.           Screen prior to the initial downloading of software by each
  45.           user. The PC-SIG Introduction screen will be supplied in
  46.           ASCII format on diskette.
  47.  
  48.     6.    BBS Licensee agrees not to download files and/or programs from a
  49.           PC-SIG diskette or The PC-SIG Library on CD-ROM disc with
  50.           the intent to sell the copy. Downloading is defined as the
  51.           process of copying or duplicating a PC-SIG Library diskette
  52.           or The PC-SIG Library on CD-ROM disc onto other media,
  53.           including, but not limited to, diskettes, hard drives,
  54.           magnetic tape or optical disc, for the intentional or
  55.           unintentional purposes of sales, distribution or financial
  56.           gain. The BBS Licensee cannot side-step the issue of a sale
  57.           by claiming that they have only charged for consulting time,
  58.           the cost of the diskette, online time, or for labor charges
  59.           only.
  60.  
  61.     7.    BBS Licensee agrees not to charge any fees for downloading
  62.           and/or viewing any portion of The PC-SIG Library, nor are
  63.           they allowed to charge any access fees. BBS operators may,
  64.           however, charge a nominal annual membership fee, which is
  65.           not to exceed $50.00 to help defray the cost of the system
  66.           operation.

  68.     8.    Because of the varying types of hardware and software for
  69.           BBS systems, PC-SIG does not guarantee the compatibility of
  70.           The PC-SIG Library on CD-ROM with any particular BBS system.

  72.     9.    If Licensee violates any provisions of this Agreement,
  73.           PC-SIG can terminate this License and continued violations
  74.           may possibly lead to subsequent legal action by PC-SIG,
  75.           among other causes of action, for violation of PC-SIG's
  76.           License, registered trademark(s) and/or copyright(s).

  78.     10.   The License fee is one hundred ($100) per year for a one
  79.           line BBS system. For BBS systems with more lines, the fee is
  80.           an additional one hundred dollars ($100) per added line per
  81.           year.

  83.     11.   Licensee agrees to notify PC-SIG, Inc., if they have or gain
  84.           knowledge of individuals or organizations that are violating
  85.           the terms of this License Agreement or PC-SIG's copyright(s)
  86.           and/or trademark(s).

  88.     12.   Should legal action result between PC-SIG and its Licensee
  89.           due to the violation of, or concerning, any of the
  90.           provisions of this Agreement, the Licensee shall be
  91.           responsible for all attorneys fees and related legal
  92.           expenses, including, but not limited to, loss of business and
  93.           profit to PC-SIG, Inc. Should litigation be necessary, any
  94.           action will be filed in the County of Santa Clara, State of
  95.           California.

  97.     13.   The PC-SIG Library is not licensed for use on BBS systems
  98.           operating outside the USA.  For other countries, contact PC-SIG
  99.           for License requirements.
  100.  
  101.     14.   This License shall be construed under the laws of the State
  102.           of California. This Agreement sets forth the understanding
  103.           between PC-SIG and the BBS Licensee; it may be changed or
  104.           modified only in writing and must be signed by the Licensee.
